Regular Alcohol Testing for Drivers in Ukraine May Become Routine

Let’s add – regular and sudden. This was stated by the Deputy Minister of Internal Affairs of Ukraine Anton Gerashchenko, who also commented on the now former Deputy Minister of Strategic Industries Vitaliy Nemilostivy, who was caught driving under the influence and resisted the police yesterday.

The deputy minister, whom few knew until today, wrote a resignation letter on his own accord. Well, conditionally on his own accord. But he was the last “straw” for MPs to consider draft law No. 2695. It provides legal rights for patrol officers to unexpectedly stop cars for an alcohol test (currently, by law, this cannot be done without a justified reason for stopping).

The document states that such preventive measures can be carried out at night, from 10:00 PM to 8:00 AM, as well as on public holidays, weekends, and during the day following them. It is also added to the law that during such an inspection, the police officer not only uses technical means but also video recording tools, and if the use of such means is not possible, the inspection is carried out in the presence of two witnesses. Video recording materials will definitely be attached to the protocol of the administrative offense and considered in court.

In addition, the draft law tightens several regulations concerning traffic violations in general. For example, currently, a violation of traffic safety rules that results in moderate bodily injury is punished by a fine of 200 to 500 untaxable minimum incomes of citizens (NMDG, 17 hryvnias). It is proposed to increase the amount of the fine to 3000 NMDG to 5000 NMDG (that is, from 51 to 85 thousand hryvnias, not from 3400 to 8500 hryvnias as it is now).

The same actions committed under the influence of alcohol, narcotics, or other intoxication are proposed to be punished not by a fine, but by imprisonment for up to 3 years (with deprivation of the right to operate vehicles for a period from 3 to 5 years). Currently, criminal responsibility is only threatened if people die in an accident, not if they are injured due to a drunk driver.
